Mr. Morehouse suggested that a compromise might be possible by including a reservation of the additional five feet to the homeowners’ association, with the provision that the land be dedicated to the Virginia Department of Transportation if required. In return, the partners agreed, the house sites of the two lots fronting on Blue Ridge Ave. would have a setback of not more than 50 feet from the road.
That restriction, Mr. Morehouse explained, would help to preserve the open space on the parcel and the view west toward the mountains from properties along Main St.
The commissioners agreed that, although the ordinance also requires curbs and gutters, that provision will likely be changed and voted not to require a bond for those improvements.
The LOMP partners agreed to post a bond sufficient to cover the cost of the road into the subdivision, as well as the estimated cost of the utilities. In addition, they agreed that none of the four rear lots served by the road would be transferred from the partners’ ownership until the improvements are completed.
With those restrictions and agreements, the planning commission agreed unanimously to approve the preliminary plat of the project as presented. The project will be returned to the commissioners for final approval when the plat of record is ready.
