Ihe other case involves a property owned by Roger Jones on Route 621 one-fourth of a mile from Route 231, Mr. McCarthy said. The owner has built al dam for a lake within 100 feet of his property line. That is a violation in itself unless he obtains permission from the adjoining property owner, Mr. McCarthy claimed.! In addition the dam, which serves to funnel water into! the lake, is causing water to back up onto the neighbors* land in an area where cattle are penned. •
The supervisors went into executive session to discuss these cases since they involve potential litigation.! Mr. McCarthy noted that in the five years since the cur-! rent zoning ordinance was passed these two cases are the first to reach this point. _»>
“No one likes to go to court,” he said. “Finally we’re coming up against two cases where the zoning ordinance is being flaunted.”
At last Wednesday’s meeting the supervisors also learned that there has been no response from Adelphia Cable to the county’s latest recommendations on the francise agreement for cable TV.
Jackson District representative Ellis Bingham suggested the county negotiate with another company, but Mr. McCarthy said no other company is interested. Col. Bingham and Wakefield District representative Hubert Gilkey said they have received many contacts from their constituents interested in getting cable service.
