Frangalina Lopez pleaded guilty to six felonies last week in Rappahannock County Circuit Court. If the sentences are served consecutively, Lopez could serve up to 85 years in the state penitentiary.
Lopez pleaded guilty to four felony theft charges and two charges of welfare fraud.
There was some confusion as to what Lopez wished to do in regard to pleading the case. Lopez’s attorney, Mark Williams, told Judge Carleton Penn, “I am not sure what she wants to do.” He said that on Aug. 25 he spoke with Commonwealth’s Attorney Peter Luke and discussed a possible plea. He said that he met with his client on Sept. 22 who could not decide what to do, and that he advised Lopez against accepting the plea agreement.
Commonwealth’s Attorney Peter Luke said, “I heard back from Mr. Williams that she did not want the plea agreement. Then he called and said she wanted her plea agreement. I felt the defendant was trying to take advantage of the system and could not be relied on no matter what the plea agreement.”
When Lopez was arrested in New York on charges filed in Rappahannock, a routine search determined “she” had a penis. Lopez, a self-proclaimed hermaphrodite, told Judge Penn, “I have some physical and mental handicaps. I am guilty for some things and not for
