Code Section 24.2-228, the remaining members of the Town Council shall appoint a qualified voter of the election district to fill the vacancy, within 30 days of the date of resignation. If the appointment does not occur within the 30 days, the judges of the circuit court would make the appointment. The person appointed will serve out the remaining term, which runs through June, 1998. Another member will also have to be replaced. Newbill Miller has moved out of town, becoming ineligible to continue serving on the Town Council.
