Rodger Bottomley’s lawyer Roy D. Bradley told the jury that his client thought the items they took were junk that no one wanted and they planned to sell them for salvage.
He said once they found out differently all the items were returned. Brown did receive all the items back and has since been credited by NAPA for them.
The attorneys and Judge Rayner Snead met in chambers and it was decided that the charge should be petty larceny because the defendant couldn’t have gotten over $250 for the parts as salvage.
The plea was reduced to petty larceny and the defendant pled guilty to that charge. The jury was dismissed as the court rules on misdemeanor charges. Rodger Bottomley will be sentenced on July 17.
