The Rappahannock-Rapidan Community Services Board shall offer for sale by means of sealed bid the following described property subject to the terms and conditions contained herein.
All that lot or parcel of land known as Parcel A, Elkwood Downs, Hackney Drive, State Route 786, Brandy Station, Virginia, Culpeper County containing approximately 4 acres as described in a deed recorded among the Land Records in Clerk's Office in the Circuit Court of Culpeper County, Deed Book 535, Page 132.
BIDS ARE DUE NOT LATER THAN 11:30 A M., MAY 25, 1999 at 15361 Bradford Road, Rt. 666, P.O. Box 1568, Culpeper, VA 22701. Sealed bids may be mailed to Attention: Procurement Department, or dropped off in person during business hours, 8:30 - 4:30. All bids should be submitted in a sealed envelope marked "ELKWOOD DOWNS PROPERTY BID".
THE PROPERTY WILL BE SOLD IN "AS IS" CONDITION, WITHOUT WARRANTIES, EXPRESS OR IMPLIED. Sale is subject to conditions, restrictions and agreements of record affecting the property, but free of all liens.
TERMS OF SALE: Cash or certified check deposit in the amount of 10% of the bid price will be required of the purchaser within two days of notification of acceptance of bid by the Rappahannock-Rapidan Community Services Board, balance within 45 calendar days.
Abstract and examination of title, all costs of conveyancing, recording charges, notary fees, settlement fees, including preparation of a special warranty deed and Grantor’s tax thereon, etc., shall Be at the expense of the purchaser. Real Estate taxes are to be adjusted to date of settlement as the RappahannockRapidan Community Services Board is tax exempt.
The Rappahannock-Rapidan Community Services Board reserves the right to withdraw the property from sale at any time prior to the termination of the bidding and/or to reject any or all bids. This property is sold subject to a reserve to be determined by the Rappahannock-Rapidan Community Services Board.
In the event of default by the purchaser, the deposit shall be forfeited by the defaulting purchaser and applied to the costs and expense of the sale and balance, if any, to be retained by the Board as compensation for said sale.
In the event of default by the purchaser, in addition to all other remedies including but not limited to attorney fees, the seller may declare the entire deposit forfeited and resell the property at the risk and expense of the defaulting purchaser. The defaulting purchaser shall be liable for the payment of any deficiency in the purchase price, all costs and expenses of both sales, attorney fees and all other charges due and incidental and consequential damages.
In the event the Rappahannock-Rapidan Community Services Board does not or cannot convey title for any reason, purchaser s sole remedy is return of deposit.
Time is of the essence as to all matters set forth above.
