A motion to declare a mistrial in the Ira Wayne Cloniger murder trial failed Friday in Rappahannock County Circuit Court.

In a proceeding that lasted just five minutes, Judge Jeffrey Parker rejected the motion because of lack of evidence.

In January, a jury declared Cloniger guilty of first-degree murder for killing Edward Carlton Fletcher Jr. The jury recommended a life sentence for Cloniger, who stabbed his friend Fletcher in the early-morning hours of July 2, 2006.

Public defender Bonnie Hoffman filed a motion on June 21, alleging that “prejudicial third-party contact”
