“Mr. Malik chose a type of lifestyle that our government and legislature has decided to be illegal” said Reynolds during the hearing. “Although he clearly deserves to be punished, I don’t think that there is a reason for incarceration.”
Commonwealth’s Attorney Pteter Luke agreed. “Mr. Malik knew it was wrong, and he knew that if he got caught he would get in trouble, said Luke. “Yet he persisted in this behavior for a number of years.”
Luke did not ask that Malik be incarcerated, but recommended that he be tested for drugs during his probation.
“Well see if he lives up to his statement that he has put illegal drug use behind him,” Luke raid referring to Malik’s testimony. "The proof in the pudding will be making him take these drug tests.”
Malik was arrested by the Rappahannock County Sheriff’s Office last July, after law enforcement search helicopters searching for murder fugitive Ira Wayne Cloniger spotted his plots of marijuana from the air
Investigators discovered 89 marijuana plants on Malik’s property in two different plots.
