defense can prove that the jury was tampered with before they readied a verdict.
Commonwealth attorney Peter Luke stated, in his argument, that it wa* unclear whether or not the jury was affected in the incident. “We don't have any testimony that proves that the jury in fact heard this statement,* he said
Luke also noted that, according to StreightifTs testimony there was no certainty that the comment was directed to any member of the jury and questioned whether die phrase itself was a prejudicial statement
Judge Jeffery Parker was dearly annoyed at the last minute motion, but after hearing threshold evidence from the defense, he agreed to an evidentiary hearing on the allegations.
Hoffman said in court that she filed the motion at' the last hour because she was still investigating the alleged incident.
Cloniger was the subject of a week long manhunt in Rappahannock County last July after he fled the murder scene of Edward Fletcher Jr who was stabbed in the throat. He was apprehended late on the night of Sunday; July 9 in a field near Massie’s corner.
Cloniger was charged and found guilty of first degree murder in a jury trial in January for the crime. The defense team maintained during the trial that Cloniger committed a crime of passion, and asked the jury to merely find him guilty of manslaughter
The evidentiary hearing is scheduled for July 20. Sentencing will be postponed until after the matter is resolved.
