NOTICE OF SALE OF VALUABLE REAL ESTATE

Pursuant to a Decree of the Circuit Court of Rappahannock County, Virginia, made and entered on the 17th day of January, 1985, in the partition suit brought by John M. Stuart against F. Bruce Comeal, Jr., and others, Chancery number 3190, the undersigned Special Commissioners will on Saturday, the 2nd day of March, 1985, at the front door of the Courthouse of Rappahannock County, Virginia, at 11:00 a.m. of that day offer for sale to the highest bidder, the following described real estate known as the “Stuart Property", all located in Rappahannock County, Virginia and the Town of Washington, Virginia: ALL THAT parcel of land with improvements thereon fronting on Route 622 and Main Street, in or near the Town of Washington, Rappahannock County, Virginia, containing 11.2739 acres, as shown on a plat of survey of the Lucy M. Stuart Estate by Rappahannock Surveys, Incorporated, Wayne E. Niskanen, CLS, dated March 4, 1975 which plat is recorded in Plat Book 4, page 29 of the Circuit Court Clerk's Office for Rappahannock County, Virginia. AND BEING the same properly in which F. Bruce Comeal, Jr. has a one-half (V2) undivided interest by virtue of a deed from Peter H. Luke, ancillary administrator c.t.a. of Estate of Caldwell Jackson Stuart, dated and recorded February 14, 1984 as instrument No. 4922 among the land records of Rappahannock County, Virginia, and further being the same property in which John M. Stuart has a one-half (1/z) undivided interest by virtue of the Last Will and Testament of William Millan Stuart recorded in Will Book 31 at Page 210 amongst the Rappahannock County land records and deed of Mary S. Stuart, unmarried, dated July 7,1983 and recorded July 11,1983 amongst the aforesaid land records in Deed Book 145 at Page 102.

TERMS OF SALE: Sale is subject to approval of the Circuit Court of Rappahannock County, Virginia. Ten percent (10%) bidder's deposit is payable in cash or equivalent on date of sale with the balance being payable in full in cash or equivalent within thirty (30) days from date of sale. All cash proceeds from this sale will be deposited with the Farmers and Merchants National Bank of Winchester, Virginia, General Receiver of the Circuit Court of Rappahannock County, Virginia.
