For my own part, a thorough review of the “new” proposed ordinance convinces me that, by far, the most unacceptable feature of it is its attempt to circumscribe and restrict the discretionary powers of the elected board of supervisors.
This is not another incidental restriction such as yard areas or permissible signs. It is a fundamental and constitutional flaw in the proposal as I emphasized at the meeting, and have before, although your article does not report that fact. Under the provision of the ordinance, as now proposed, the supervisors would, upon its enactment, lose control over the implementation of the ordinance by surrendering their discretionary powers over granting Special Exemptions to address bonafide grievances of the electorate, as they did for Mr. Clark and his neighbors of Harris Hollow in their bitter battle with Sam Snead over his proposed development up there, and did so for Mr. Reynolds and his clients,
