AND DISCLOSURE BY THE SELLER There used to be a saying in the Real Estate Business "Buyer Beware." In other words, the Buyer should be cautious when buying property to be sure of what they were buying. Today Buyers are routinely represented by Buyer's Agents. Agents who are employed by and represent only the Buyer in a real estate transaction. Therefore, home inspections are a common practice today. Home Inspectors are hired by the Buyer to do an extensive inspection of the home and to evaluate the home's condition. Sometimes licensed contractors or engineers are consulted when a problem is discovered. This practice of Home Inspections and Seller Disclosure (a form sellers have to fill out disclosing the condition of their property or a statement saying they are selling their home "as is") have gone a long way in eliminating problems between the Buyer and Seller and have taken the Real Estate Agent out of the middle with regard to defects and condition of properties. It has also eliminated the need for a number of lawsuits stemming from defects found after the sale. It is important therefore that sellers understand this practice and have their properties in good condition when they put them on the market or warn the Buyers of "as is" condition. It is also important that they disclose any known defects to the Buyer prior to the contract. The practice of Home Inspections and Seller Disclosure has had a positive influence on the Real Estate business and is here to stay.
