Last Wednesday the Rappahannock Board of Supervisors approved a change in the county zoning code concerning family apartments. In the law, a family apartment is a secondary apartment, near a primary house- such as a mother-in-law cottage or a garage apartment, built for family members to live in.

While you may not build two large houses right next to one another, or fill a single residential plot of land with rental houses, you may build a family apartment to help relatives.

The code tries to make it difficult to use this exception as a loophole for building rental properties willy nilly around your property, or getting around the law by subdividing your plot of land into multiple dwelling units.

Prior to the Board’s vote on the changes, County Administrator John* McCarthy described the changes as “a liberalization of the current requirements” Under “one interpretation of existing law,” McCarthy explained, building a family apartment attached to a larger structure- such as an apartment above a garage, is essentially forbidden because under the old code, the combined size of both the apartment and the garage are counted toward
