In November, Trumbo sent Luke a six-page letter that outlines the company’s objections to the ordinance in progress. On Dec.l, Recyc’s attorney, Timothy G. Hayes of the Richmond law firm Hunton & Williams, wrote Luke a seven-page letter with objections to the draft.
In both letters, Hayes and Trumbo question whether the county has the authority to enforce legislation that goes beyond what state regulations require for companies that apply biosolids to land.
For example, the draft ordinance calls for 100-foot vegetative buffers around areas where biosolids are spread on land. That is twice the size of the requirement set forth by the Commonwealth.
