As an example, Luke noted that the Bay act has been used for county rules on erosion and sediment control around bodies of water. He also said parts of the act might be used in a plan to control the total maximum daily load of pollutants that flow into Rappahannock’s waterways. McCarthy said the act will also be used to write a new stormwater ordinance for the county.
McCarthy said the County Board of Supervisors will have to decide if the Chesapeake Bay Preservation Act can be applied on top of state regulations. Such considerations will likely be major factors in the' board’s decision to adopt or reject the ordinance.
The concerns expressed in the letters from Hayes and Trumbo will be used to revise the current draft of the ordinance before the committee’s next meeting, which is scheduled for Feb. 7. McCarthy said the committee’s goal is to have the draft ordinance ready for the Board of Supervisors’ March meeting.
