arose in connection with approval of C. L. Goode’s proposed '' Flfnt Hill development.

The supervisors denied rezoning for the 14 lot, fiveacre subdivision in August, 1977. Goode filed suit challenging the county’s action. The case has been repeatedly continued and is still before the court with the next hearing date scheduled for March 12.

In the meantime, however, Goode applied for approval under the county’s subdivision ordinance in December, 1978. Following a public hearing on February 1, 1979, the supervisors ruled that his proposed development did not “substantially comply” with ordinance requirements on slope. They based their decision on the fact that each of the 14 lots did not have five acres below 14 percent slope as required by the subdivision ordinance.
