Charles "Pete” Estes. ‘This has to be handled in a manner so that it doesn’t affect somebody down the road or subdivisions in the past...We can’t arbitarily pick a group and say you can do this," he maintained, suggesting that the commonwealth’s attorney write an ordinance amendment that would permit someone to subdivide a non-conforming lot for conveyance to a community organization for public use.
An amendment isn’t necessary, Luke said, because the board has the power to grant an exception to any provision of the subdivision ordinance.
“But it’s never been done," Estes countered. He added, however, that “if you can, in good conscience, do this without damaging the ordinance, fine.”
Chairman J. R. Latham noted that granting the exception would not change the character of the neighborhood.
“This will benefit so many people,” said Baldwin, maintaining that the benefit to many must be weighed against any potential damage to the few opposed.
“If the right-of-way is widened to 40 feet, I think it will benefit everyone involved,” Latham maintained.
“I think we would be doing an injustice if we didn’t grant this,” Supervisor Hubert Gilkey added.
Latham agreed. “The most valuable resource our county has in my estimation is its vouth.”
