He was charged with driving after having been declared an habitual offender and driving while intoxicated.
Because of his previous record, if the defendent was found guilty, he could do time in the state penitentiary.
However, under a complex set of Virginia laws and regulations — which are maintained on a computer rather than by hand — the commonwealth could decline to prosecute the more severe charges in return for a guarantee of a longer jail sentence in the county jail.
In short, the greater charge resulted in a lesser jail term.
