“A defense lawyer doesn’t want his client to go to the penitentiary, so if there’s a good chance for a conviction, the lawyer will want to avoid it with a plea bargain,” Luke said. “From the Commonwealth’s point of view, I’m looking for the maximum sentence I can get, but unless I’m confident I can get 10 years or more, 12 months in jail is my best bet.”
