where Mr. Selvage was standing on the trail to where he said the deer was standing when he shot it was 126 feet. The distance from i, position to the tree behind which Mr. Gray’s body was discovered was 194 feet. From the spot where Mr. Price and Mr. Selvage met to where Mr. Selvage took his shot was 95 feet.)
Mr. Price testified that he met Mr. Selvage on the trail near the summit of Turkey Mountain just before 5 p.m., as he walked up and Mr. Selvage walked down the mountain. He said that they had a short conversation, then heard a noise a short distance up the hill from where they stood on the trail.
He said that he walked down the hill and Mr. Selvage walked uphill, when he heard more sounds “and saw a glimpse of something in the honeysuckle. I put the safety back on (my rifle), turned uphill and saw Mr. Selvage aiming uphill — the next thing I knew, he shot.”
He added, in response to a question from Mr. Luke, that “he didn’t look too long before shooting... He hesitated a second or two; then he went up the mountain where I couldn’t see him.”
Then, Mr. Price continued, the next thing Mr. Selvage said was “Mr. Price, I’ve shot someone.” Mr. Price said he replied, “No, you didn’t.” He said that Mr. Selvage shouted back, “Yes, I did.”
“It wasn’t very long between the shot and his call,” Mr. Price recounted. “I was still walking up the path.” When Mr. Selvage shouted, he testified, he went straight up the mountain toward Mr. Selvage’s voice.
“That’s when,” Mr. Price said in a soft voice, “I found my stepson lying on the ground.”
