RICHMOND — A Virginia Circuit Court judge has fined Avtex Fibers Front Royal Inc. $990,000 for violating an agreement with the State Water Control Board to cease polluting the Shenandoah River.

The rayon manufacturing company may shake the fine imposed last week, however, if it succeeds in making mandated repairs by next February.

Since Avtex officials signed a consent decree in January, Avtex violated the agreement with the State Water Control Board on approximately 18 different occasions, resulting in 99 violations of the state permit.

Judge T..J. Markow fined Avtex the maximum civil penalty of $10,000 per violation, but stipulated that the company may purge itself of fines by compliance.
