The arrangement may have saved the company, which told the judge at the June 31 hearing that should the $2 million fine agreed to in the consent decree be imposed immediately, the company would have to close its doors.
Despite the heavy fine, Judge Markow, who toured the aging plant in June, did not fault the company’s efforts to comply.
“Avtex has not willfully or deliberately violated this court's final consent decree,” the judge said. “It has made and is making good faith efforts to repair the plant to prevent pollution discharges into the Shenandoah River.”
Both Avtex and state officials responded positively to the judge’s decision.
