the line isn’t needed for Virginia,” said Sutliff, who lives near Warrenton. “Until Dominion files with the SCC, I can’t be more specific” about Fauquier’s strategy. “There will be work done in advance, but the process starts when they submit.”
Fauquier’s legal tab probably would be spread over three fiscal years, Burke said.
An existing $46,000 legal fund for unspecified purposes would cover power line-related costs during the current fiscal year, which ends June 30. Burke estimated Fauquier’s fiscal 2008 legal expenses to fight Dominion and its4 partner, Allegheny Power, at $200,000.
The supervisors committed no specific amount to Fauquier’s battle against Dominion and Allegheny. Nor did it put a “cap” on spending, the county attorney said. “Well have to look at [cost] on a fairly regular basis,” Burke said.
Dominion plans to submit an application for the proposed line to the SCC in April.
The SCC will conduct two hearings on the proposed line, one in Richmond and the other in the region affected by the project. Like a court of law, it will accept evidence and testimony. Those who testify can be questioned and cross-examined by lawyers.
The SCC’s three-member board (called ^judges”) determines whether a need exists for the proposed line. If it finds in favor of Dominion, the corporation board also will identify the appropriate route.
