On September 21, Baumgardner got his answer and it was a resounding "No!" Not only did Stone repeat his advice that the school board may continue to decline the document requests "at this time;" he questioned whether Freedom of Information laws apply at all to the school board.
"The (draft architectural) report, as related to me. was intended to be used in executive session by the superintendent so that the school board could consider in detail the superintendent's initial suggestion for this construction project.” Stone wrote.
(In actuality, however, the report was discussed for over two hours in open session at the school board’s August 4 meeting. At a meeting held the following week, the board discussed the revised report at length, also in open session.)
