Stone also based his opinion on the FOI provision that exempts from disclosure working papers compiled exclusively for executive or closed meetings. He noted, however, that “comment on the subject of the papers may be made in open session."
Finally, he maintained that the architectural reports on the proposed new facility include data related to the estimated cost of the new facilities, the construction of which eventually would involve competitive bidding or bargaining. Therefore, "the School Board may have a legitimate concern over a possible adverse effect of disclosing this information at this time," the Harrisonburg attorney concluded.
(According to the architect who prepared the contested documents, dollar figures included reflect regionally adjusted averages for labor and material costs on similar type construction taken from several national publications as opposed to actual cost estimates. In addition, design alternatives proposed by Mosely-Henning in both the original and revised architectural reports and analyses were rejected by the school board as too expensive.)
