Following an executive session late Tuesday night, the Rappahannock school board returned to open meeting at 12:15 am. and voted unanimously to accept unspecified recommendations from its special counsel, Harrisonburg attorney Phillip Stone.
Virginia’s Freedom of Information Act specifies that any action taken in executive session must be repeated in open session. Contacted by telephone on Wednesday morning, school administrators and a member of the school board were asked how the motion on Tuesday night did anything more than make a sham of that FOI requirement
In response, superintendent Robert Estabrook authorized assistant superintendent Gerald Lysik to elaborate on the motion. By their vote to accept Stone’s recommendations, contained in a recent letter, the board members agreed not to release the architectural reports on the proposed bus shop and central office sought by the Rappahannock News and commonwealth’s attorney
