That question became a hotly debated issue after Gregory was acquitted last May of the attempted second-degree murder of Ms. Dana. Although jurors said after the trial that they had found Gregory not quilty "on the facts of the case,” some spectators contended that it was Ms. Dana's moral conduct, and not her husband's actions, that had been judged.
Gregory was convicted in December 1980 of attempting to kill Ms. Dana by a Loudoun Circuit Court jury. That jury recommended he serve an eight-year prison term. But the verdict was set aside last year when Judge Penn found an error had been made in the trial, and last May’s proceeding was moved to Westmoreland County because of the amount of publicity the case had received.
