Loudoun Circuit Court Judge Carleton Penn questioned prospective jurors two at a time in a voire dire that lasted nearly three hours. Most of the inquiries were standard, aimed at eliciting what jury panel members had learned of the case and other factors that might prejudice their judgement of the case.
At the request of Loudoun Assistant Commonwealth’s Attorney James E. Mechling, Judge Penn also asked jurors if they feel that “a husband who is separated from his wife for several months is justified in attempting to kill another man if he finds her in the act of sexual intercourse with that man in that man's house.”
Although most said they feel the a^t would not be justified, one man questioned hesitated a moment and then replied: “I think it’s just cause, possibly."
Under further questioning by Mr. Mechling, the panel member said he had misunderstood part of the question and that if the incident had occurred at his own home, “then I think I would have the right, but if it
