Inadequate Notice
In consultation with the zoning administrator at the start of last Friday’s long agenda, the BZA members acknowledged that advertising for the publichearings on the ten special use permit applications did not meet legal requirements set by Rappahannock's zoning ordinance.
The ordinance. by reference to the State Code, provides that public hearings on special use permits must be advertised for two weeks with the final notice appearing not more than 21 days or less than six prior to the hearing date.
Friday’s public hearings were advertised in the Rappahannock News for two weeks but the last notice was printed in the issue which came out the day prior to the BZA meeting.
To correct the error, the BZA chairman indicated that the permit applications will be readvertised for public hearing.
