In opening statements, Mr. Mechling urged the jury to be primarily concerned with the “bare bones" of the case and promised that the evidence would show that “Theodore Cecil Gregory shot and killed an unarmed, naked man.”
While Mr. Mechling centered his statements on the night of the shooting, defense attorney Blair D. Howard chose to focus his opening on the devastation, he said his client felt when his six-year marriage to Ms. Dana was shattered with their separation four months before the murdei*
Mr. Howard promised the jury that it would be shown through testimony that Gregory “was not functioning in a normal way, that he was acting like a robot, that he was obsessed.”
The attorney also indicated that the defense, as it has in the past two trials, would draw out inconsistent statements in Ms. Dana’s testimony and show how her conduct after the separation contributed to her husband’s “mental disorders”.
