Judge John Alexander dismissed unlawful burning charges against H. W. Mundy after his lawyer moved to strike the evidence on the theory that the burning law may never have been adopted in the county.
Mundy was charged with burning within 300 feet of a woodland area, but his lawyer maintained that the commonwealth’s burden of proof was to show that the law had never been adopted by the Board of Supervisors.
Commonwealth’s Attorney Peter Luke says he learned that the ordinance had been adopted in 1941, but added that there is no county ordinance book in which the judge could check. Luke said he would research the records.
Mundy was found guilty of cursing and abusing an officer, a charge arising from the same incident on March 24. The charge was reduced from attempting to intimidate an officer through force of threats, Luke says. Mundy was fined $50 phis $35 court costs.
