According to rumors, the decision has already been made to use a trailer, Kramer said, asking exactly what is planned and where it will be placed.

A trailer can only be temporary under the zoning ordinance, Kramer explained. If the board grants the special use permit and variance to expand the church, Burke still can’t move in a trailer, he emphasized.

The Sunday school building will be used “maybe two or three years, maybe four depending on how we grow”, according to Burke’s testimony. Trailers are ordinarily approved by the BZA for temporary use while a permanent building is under construction.

The Sunday school trailer will not be a trailer if it is placed on a permanent foundation, zoning administrator David Konick told the board. Besides, he said, the zoning ordinance section dealing with trailers is limited to homes and offices. A Sunday school “is not a temporary human habitation”, he said.

“I think your interpretation is incorrect,” countered Kramer.

“That’s not your decision today.” Konick explained the BZA must decide whether to grant a special use permit to expand the church. As zoning administrator, he will review plans and issue any building permit. If the BZA disagrees with his interpretation, it must appeal his decision and ultimately take the matter to circuit court.

“What I hear is that not everything has been up on top of the table,” commented Kramer.
