The U.S._ Supreme Court recently ruled against the state of Georgia ip a suit a distiller brought to recover $2.4 million in taxes it said it had illegally been made to pay.
Though the ruling had no specific application to a suit brought by Fed, eral retirees in Virginia seeking restitution of some $400 million in taxes already decided unconstitutionally levied on them, the ruling gave no comfort to Virginia officials fighting such a huge refund.
In fact, legal experts say the highest court in the land has consistently been sending a message that people who have a valid claim that they were illegally taxed are due refunds. In a Florida case last year, the court said, “The state’s interest in financial stability does not justify a refusal to provide relief.”
