For years Sallie Atkins and her family have been claiming that the family subdivision provisions of the county’s zoning ordinance are unfair because she was not allowed to divide off a lot for her daughter Shirley Berry to build a house on.
When she first approached the county government, she said she had three acres. She was advised to buy another acre so each of the lots would have the minimum two acres. She bought another acre from a neighbor, but then it turned out that she had not had three acres to begin with, and with the additional acre, she now had 3.1 acres, still too small for the subdivision.
Recently Mrs. Berry’s husband died, and Mrs. Atkins instead requested a special use permit to build1 a family apartment for Mrs. Berry and her son.
The ordinance allows family apartments providing they contain no more than 800 square feet of living space. Mrs. Atkins applied for an 800-square foot building with a fullsized unfinished basement below the apartment. The building is to be built on a hill, and it will be possible to walk out of the basement on grade 4evel.
