Jimmy Swindler Jr. polled the members by telephone. When Chairman Gene Leggett and member Charles K. “Pete” Estes agreed to the conditions, Mr. Swindler signed a Fax of the document in Mr. Baumgardner’s office. The WSA was scheduled to hold a special meeting Wednesday evening to formally vote on accepting the order and sign the original document.
Most members said they were reluctant to pay any fine, but they felt paying $4,000 would be less costly than pursuing the matter in court.
The fine is half of the $8,000 that SWCB staff members had originally proposed and a fraction of the $25,000 per day that state law allows for violation of discharge permits.
