Mr. McCarthy said that prior to July 1, the county did not have much power to influence what is being built if the road is to serve less than three houses in a subdivision. The law changed in July, Mr. McCarthy said, making the state’s erosion and sedimentation control laws affect single family lots if more than 10,000 square feet of land is disturbed in the building project.
He said he would recommend that anyone applying for a building permit sign a paper saying he would obey the laws. In addition those building in conservation zones would be given a copy of standards for following the state’s laws in building.
Mr. McCarthy noted the planners had requested that VDOT enforce its own laws that require driveways to be nearly level the last 20 feet to the intersection with a state road. Some members said they had seen roads put in recently that seem to violate this provision.
