parcel would be worth around $75,000 if it were legal to build a house on the parcel. Konick arrived at the figure of $75,000 after consulting with real estate appraiser Alvin Henry, who testified before the Board on Friday.
Without a variance and therefore no possibility of building a house on the land, its value has been estimated at anywhere from $5,000 to $10,000, based on county tax assessments and Henry’s testimony. Konick argued to the Board that this decrease is “a hardship approaching confiscation. It is almost [the BZA’s] primary function to prevent such takings or preventions.”
No variance
County residents Clyde Humphrey and Gwen Hays, a married couple who own land neighboring the parcel in question, asked the BZA not to grant the variance. They contend that since without a variance the AVFRC could still sell the land, the current zoning status does not amount to a confiscation.
“The only use this applicant has for the property is to sell it for cash to finance fire and rescue operations. Denying the requested variance does not restrict that use,” explained Humphrey in a letter which he read aloud at the BZA meeting. Hays and
