Peter Luke recused himself. After over an hour of closed session, the Board reconvened to announce their decision. Before the Board voted on the issue, Vice Chairman Alexander Sharp proposed that the board grant the variance but include a provision that any proposed builder would have to be subject to further BZA review and approval. However, Sharp’s proposal was met with little, response and the Board voted 3-2 to deny the variance. Charles Estes II, Jennifer Matthews and Chairman Weinberg voted down the proposal, with Farrell Nicholas and Vice-Chdirman Sharp dissenting. As he left the meeting following the decision, AVFRC president Jack Atkins told the board that he would “see them in court,” and Mr. Konick confirmed that Mr Atkins will be meeting with the Board of Directors of the AVFRC, seeking approval to appeal the BZA’s decision to the Circuit court.
