Baumgardner said the county’s zoning code is heavy on the use of special exceptions, which lead to zoning on a case-by-case basis. In response to neighbors who have said the business does not mesh with the neighborhood, he said, “We have to ask ourselves, ‘What is the reality of the zoning ordinance?* “
Attorney Brown said the operation currently generates less noise and odor and requires fewer vehicles and buildings than a farm. He also said it is not the type of business where clients visit the site, so there is no threat of increased traffic from customers.
Even so, the attorney said his client was willing to adhere to self-imposed restrictions, including limited hours of operation and a ban on outdoor storage for machinery.
Several residents of Seven Ponds Road as well as some concerned citizens from other parts of Rappahannock were not appeased by the offer for self-imposed restrictions nor were they in agreement that the site was less disruptive than an agricultural operation.
