Baumgardner suggested that the board approve a one-year permit that would be subject to review, with board power to terminate the permit in the case of violations.

“We truly want to address these concerns,” Baumgardner said, adding that he and his clients want to work with the community as well as preserve the business.

Frazier said that during the past several months Brown has not adhered to conditions that were set out in his permit application, and went on to say that the time for making concessions on the issue had passed. Frazier then moved to reject the application for the special-exception permit Welch seconded the motion and said he did not want the board to delay a vote on the issue any further. The other three supervisors also voted against the permit.

McCarthy said B&S has the option of appealing the supervisors’ decision with the Board of Zoning Appeals in January. Baumgardner said he and his client have not decided whether to pursue that appeal.
