cases of “changed grade” causing flooding and other drainage problems which only occurred when VDOT came to “fix” a problem (which often only existed in the mind of VDOT) on a road which the landowner owns!
There are too many times when landowners have attempted to avoid problems developing by advising VDOT of local site specific conditions and suggesting constructive methods of dealing with the situation only to be summarily dismissed and/or ignored by VDOT. How many beer, wine and whiskey bottles as well as general trash have you found on your land left by the contractors working for VDOT?
And then VDOT claims that the acts of contractor’s employees are not controllable by VDOT, and further, awards the same contractor more state work! (Do you think VDOT picks up that trash?) These acts appear arrogant, ignorant and incompetent. I believe that some might find them grounds for rescinding easements or even personal liability!
