The BZA had asked the board, which has enforcement authority, to make a decision regarding what the BZA considered to be a violation of the 1973 Zoning Ordinance.
The board’s decision, announced in public session by Supervisor Gilkey: “(We) will allow (its use) as a singlefamily for the time being as long as only one family is (living there) related by blood or marriage.”
In addition, Supervisor Gilkey said, no more buildings of this type will be allowed. He said that Saltonstall would be notified of the board’s decision in a letter from Commonwealth’s Attorney Peter Luke.
Supervisor Lane motioned that the board also send a letter to the zoning administrator advising him that “not the use but the erection” of a dwelling is “clearly stated” in the ”73 Zoning Ordinance. Board members agreed with the BZA that the zoning administrator had erred in granting the building permit for the structure.
