Hie board noted after its decision that any enforcement of the ruling would have to come from the Board of Supervisors. “We also will note that Mrs. Saltonstall did not fail to disclose anything,” Bird said. “She presented the plan and got approval of it before she began, and the approval of the building inspector and the certificate of use and options was granted.”
The board advised Baumgardner of its decision not to consider the new information, and he noted his exception to the ruling.
When asked why Saltonstall built the structure in a duplex style after its plan had been disapproved once before, Baumgardner said, “She liked the design and she didn’t want to change it.
“It’s a question of law,” Baumgardner continued. “The question is if you design a structure that’s still consistent with single-family use, but could be used another way, is the building in violation?”
Baumgardner pointed out that there are many houses in Rappahannock County that have separate living quarters for members of the family. “Right now those living quarters are legal because they are inhabited by members of the family, but at some future date those quarters could be rented out,” Baumgardner said.
In other action Wednesday, the board decided to table for Anther consideration a request for a renewal of Special Use Permit No. 118 for the Child Care and Learning Center. Kramer made the motion to table the request because he had not received information needed to make a decision.
The board also approved a variance request for Alexander K. Davis.
