5. To prevent the enactment in any local zoning legislation of provisions which attempt to place the burden of proof on persons accused of violating or attempting to violate the ordinance, it is the job of the grantor of a permit to show and prove, from the ordinance itself, that a violation has occurred or would occur, insufficiency of proof should deter the regulator, not the regulated.
