On June 18,1985, The Potomac Edison Company ("Potomac Edison”) filed an application with the State Corporation Commission for an increase in its base rates which would result in approximately $9.6 million additional annual revenue. Potomac Edison projects that the increase in base rates will be offset, in part, by a reduction in its fuel expenses amounting to approximately $5.9 million annually. The application states that the $9.6 million increase in base rates is necessary because of increased costs for facilities, materials, and services used by the utility as well as for costs associated with.the expected start-up of the Bath County Pumped Storage Project. Forty percent of this 2,100 mw generating facility will be owned by Allegheny Generating Company (“AGC”), a wholly owned subsidiary of the operating companies of the Allegheny Power System. Potomac Edison will own approximately 28 percent of the common equity of AGC. , By preliminary order filed July 19, 1985, the Commission assigned Case No. PUE850029 to the application and suspended the tariffs for a period of 150 days to and through November 14,1985. By order filed August 5 the Commission scheduled a public hearing to commence at 10:01 a.m., on November 12,1985, in the Commission’s 13th Floor Courtroom, Jefferson Building, to receive evidence relevant to the proposed increase in base rates.
By order filed August 5,1985, the Commission established Case No. PUE850048 to consider revisions to Potomac Edison’s fuel factor and cogeneration tariff and directed Potomac Edison to file evidence in that proceeding on or before October 1, 1985. The Commission has scheduled a public hearing to commence at 10:00 a.m. on November 12, 1985, in the Commission’s 13th Floor Courtroom, Jefferson Building, to receive evidence relevant to Potomac Edison’s fuel factor and cogeneration tariff.
Parties who wish to speak at either public hearing and not participate as a Protestant, may be scheduled by writing to the address listed in the last paragraph of this notice. Any person who wishes to comment in writing on either proceeding should send such comment to the same address. Written communications to the Commission should explicitly identify the appropriate case number(s).
On or before October 1,1985, Potomac Edison will propose a fuel factor and cogeneration tariff and file supporting testimony and data. These tariffs will become effective for the period commencing with the billing of Potomac Edison for power from the Bath County Pumped Storage Project. The utility anticipates that the effective date of the new tariffs will be in mid-November, 1985. On or before August 15, 1985, Potomac Edison will file its fuel cost data (FH Reports) for the three months ending June 30, 1985.
Copies of the applications and the testimony of Potomac Edison’s witnesses in each case may be reviewed at any office of Potomac Edison where bills may be paid and at the SCC Document Control Center, Floor B1, Jefferson Building, Richmond, Virginia.
On or before September 10,1985, all persons who expect to submit evidence, cross-examine witnesses, and otherwise participate as Protestants in either case, as provided by Rule 4:6 of the Commission’s Rules of Practice and Procedure, shall file, with the Clerk of the Commission, an original and twenty (20) copies of a Notice of Protest in each proceeding in which Protestant desires to participate as required by SCC Rule 5:16(a). A copy of the Notice(s) of Protest shall be served on Potomac Edison’s counsel, John W. Riley, Esquire, Hunton & Williams, P.O. Box 1535, Richmond, Virginia 23212.
On or before October 25,1985, all persons who have filed a Notice of Protest and who still expect to participate in the hearing as a party Protestant must file an original and twenty (20) copies each of a written Protest in each proceeding in which Protestant desires to participate as required by Commission Rule 5:16(b) and of all prepared testimony and exhibits of the witnesses to be offered at the hearing in each proceeding and shall serve five (5) copies thereof upon counsel for Potomac Edison and three (3) copies upon all other Protestants.
On or before October 25,1985, the Commission’s Staff shall file with the Clerk the prepared testimony and exhibits of each witness expected to present direct testimony in each proceeding and shall serve a copy upon counsel for Potomac Edison and each Protestant.
On or before November 5, 1985, Potomac Edison shall file with the Clerk and each Protestant the testimony and exhibits il expects to introduce in rebuttal to the direct pre-filed testimony and exhibits of the Commission Staff and the Protestants in each proceeding.
Any party participating as a Protestant should review the instructions regarding discovery set forth in the Commission’s order dated August 5,1985, in each proceeding.
