“Area A is everything else in town except that buildings with less than 25 percent of their first floor area lying within town boundaries are excluded,” the ordinance reads.
Architectural styles from the town’s settlement to 1900 will be compared to exterior changes in existing buildings or to new construction in Area A.
The council made one change in the ordinance that gives the town the authority to block demolition of buildings thought to be of historical significance, as determined by the ARB.
The ordinance’s time frame was changed to begin at the town’s settlement rather than its founding date as originally cited in the proposed ordinance.
“Some of the buildings in town pre-date the town’s founding,” said Mayor Peter Kramer, who raised the question before the council. “As I read
the ordinance, those buildings could be taken down, and the ARB would have nothing to say about it.”
A public hearing on the ordinance was held during the meeting. One town reside: c asked about the constitutionsdity of the ordinance since it legislates the use of private property by private citizens.
“Someone might mount a challenge on that basis, but ordinances like :his are constitutional,” Kramer said.
