“I have no objection, but I think the BZA would have to put strict requirements on for clean up,” said Planning Commissioner David Fannon.
“Mr. Russell has certainly kept his lot neat so far,” noted Commissioner Werner Krebser.

“Here’s something for you to consider as well,” interjected Zoning Administrator John McCarthy. “When does a yard sale become a flea market?” He reported that 50 percent of the complaints received by the zoning office relate to “setting up tables and spreading out junk over the yard.” When questioned, the property owners insist the use is allowed by right since they’re selling their own household goods, Mr. McCarthy said. But then they sell three households worth of items over the next three weekends, he added. “Though I don’t specifically have a problem with that, the neighbors sure do.”
Mr. McCarthy added that at least Mr. Russell had been “up front” about his plans to conduct a flea market and applying for a special use permit, rather than calling it a yard sale and attempting to slip it by. “We haven’t had many who are.”
“This is one of the better locations for this type of operation,” remarked Planning Commissioner John Clark. In response, the planners voted unanimously to recommend approval of the special use permit, on the condition that (1) Mr. Russell be limited to 30 tables to be
