Timothy Duane Reid, 32, of Stafford, found out that it’s not a good idea to violate the terms of probation.
Last Thursday, Circuit Court Judge W. Shore Robertson told Mr. Reid that he would have to serve the original five-year sentence that he was given over a year ago. Mr. Reid had been found guilty of possession of PCP and Cocaine. In lieu of serving a five-year sentence, Mr. Reid applied to be accepted into the CDI program, which is a form of probation and community service. He was accepted into that program in June, 1994.
Last April, Catherine M. Heritage, Executive Director of the Fauquier/Rappahannock Division of the CDI program, which is now known as the Middle Virginia Court Services Program, Inc., notified the court that Mr. Reid had not only missed several scheduled appointments with her, but had tested positive for marijuana use twice, last February and March.
Mr. Reid’s attorney, public defender Roy Bradley, argued that his client had completed his community service hours and that he was compliant with the CDI program up to the time of the urinalyses which showed he tested positive for marijuana use.
