During closing arguments, Mr. Luke informed the jury that they could take the tapes into the jury room, and that he felt they were the single most important evidence in the case because “You can hear what happened as it unfolded.”

Mr. Luke told the jurors that it didn’t matter whether the gun was loaded or not, and that if he was holding the gun as to reasonably induce fear then he was guilty of brandishing. There is something missing in the puzzle of this case, said Mr. Luke. “The defendant says Gary Jordan is like a son to him yet he goes to his house with a gun. Somewhere something happened. The Commonwealth believes the factor was bad blood.”

Mr. Luke said he did not believe this was a self-defense case.

Mr. Baumgardner told the jurors that they should ask themselves whether the words of his client were the words of a killer ©r if they were the words of a frustrated man who was fed up with being harassed. “I suggest to you that it is reasonable in this case that Gary Jordan was the aggressor.”

He reminded them that Mr. Jordan was drunk the day of the incident and had admitted that he could not remember everything that happened. “These were not the actions of a guilty man. These were the actions of a frustrated man” he said.
