Virginia law provides for the replacement of eased land deemed essential to achieving a public benefit, Fallon said. But that law has never tested in court in the context of a proposed transmission line.
The Virginia AttorneyGeneral provides legal counsel to VOF. “We see no merit in the Hazel complaint against VOF and we will respond appropriately once we receive service (of the lawsuit),” spokesman David Clementson said.
Dominion spokesman Jim Norvelle declined to comment on the Hazel lawsuit. “When we started the (power line Ration) process we were respectful of the (VOF) easements,” Norvelle said. “We thought we could find a viable route and move around the easements. We believe we’ve been successful in that.”
At the same time, “we believe we have the legal right to cross open space easements with transmission lines,” he added. And Dominion will do that if needed, Norvelle said.
In December, the Fauquier supervisors accepted conservation easements on 1,600 acres in the transmission line study corridor. Some of the land apparently lies within the paths of a potential power line.
On Thursday, five more landowners will ask the supervisors to accept county easements for about 775 acres in the corridor.
